Democrats have until 10 PM to file an appeal with the New Jersey Supreme Court

A state appellate court will allow Passaic County Republicans to replace their candidate for sheriff on the June 7 primary ballot but told the county clerk that she can hold off printing ballots until tomorrow to allow Democrat to file an appeal with the New Jersey Supreme Court.
The two appellate judges, Allison Accurso and Catherine Enright, upheld Superior Court Judge Ernest Caposela’s decision to allow the GOP to replace Troy Oswald, who failed to meet a statutory three-year residency requirement, with Mason Maher.
“Oswald plainly filed the required number of signatures on his nominating petitions. He was disqualified because he failed to meet the residency requirement, not because his petitions were lacking,” the judges wrote. “We see no reason the Passaic County Regular Republican Organization could not fill the vacancy
Democrats have a deadline of 10 PM to file if the state’s top court, if they want to, although the Supreme Court is not obligated to take the case.
County Clerk Danielle Ireland-Imhof must begin to print GOP primary ballots on Friday, unless the Supreme Court grants another stay.
The deadline to mail military and overseas ballots was last Saturday.
Passaic County Republicans were represented by Jessica Sprague.
